In the News
In the Chinese Drywall MultiDistrict Litigation, Judge Fallon announced this morning that a global settlement has been reached with Knauf (KPT). The settlement will include all plaintiffs who filed claims against KPT prior to December 9, 2011.
The final settlement document is not presently available. It will be made public and posted on December 20, 2011.
The general terms of the settlement were described as follows:
Pursuant to the settlement, KPT will provide 100% of the cost of remediation of homes with KPT drywall. The remediation can be done either by contractors selected by KPT or by contractors chosen by the homeowners. There is no limit to the size of this fund. It is estimated that the total remediation costs will between $800 million and $1 billion.
The settlement will also provide a "cash out" option. Plaintiffs selecting this option will receive the cost of remediation, discounted by $4 per square foot.
Finally, the settlement will create a $30 million "other loss," funds. Plaintiffs can make claims against this fund for economic losses caused by Chinese drywall as well as claims for personal injuries.
Knauf has further agreed to pay attorneys' fees and costs. A capped fund of $160 million will be set up for this purpose. Plaintiffs will not be responsible for payment of any attorneys' fees or costs.
We will circulate the settlement documents when they become available on December 20, 2011. The Court has scheduled a Preliminary Approval Hearing for January 4, 2011.
