In North Carolina, a person who tries to settle a personal injury claim on their own is virtually certain to fail. Due to its doctrine of contributory negligence, North Carolina is one of the most difficult states in which to obtain compensation for your injury.

An experienced NC injury attorney at Rhine Law Firm knows how to build a strong case and protect your rights. We are well-versed in the tactics of insurers trying to deny claims. We also have more than 30 years of litigation experience and has recovered hundreds of millions in settlements and verdicts for North Carolina clients. Our track record is second to none.

NC’s Contributory Negligence Rule and What It Means for You

North Carolina operates under a strict contributory negligence rule when it comes to liability in personal injury cases. Most states use a comparative negligence standard in which the plaintiff and defendant are assigned a percentage of fault. The percentage of the plaintiff’s fault reduces the amount of damages, or compensation, by that amount.

That is not how it works in North Carolina. Here, if the plaintiff is even 1 percent at fault for their injury, they cannot collect damages. That means many, if not most, personal injury cases cannot go forward. Even if it appears that the plaintiff had zero responsibility for the accident, insurers will investigate any claims thoroughly to see if there is that 1 percent of fault can apply and avoid paying damages.

For instance, a plaintiff seriously injured when a car ran a stop sign and hit them may appear to have had no fault in the crash. However, if an insurer can obtain black box or other data from the vehicle or accident site and show that the plaintiff’s car was traveling 10 miles over the speed limit at the time of impact, that small amount of fault may scuttle the lawsuit.

Can You Override the Contributory Negligence Law?

Last Clear Chance Doctrine

Under this narrow exception to the contributory negligence rule, the plaintiff may still collect damages if the defendant had “a last clear chance” to avoid the accident but failed to do so.

For example, if a pedestrian jaywalks and gets hit by a car, the injured party may still collect damages if it is clear that the defendant motorist had ample time to stop but did not. The burden of proof for the plaintiff is high. They must show, possibly by the use of surveillance footage, that the driver made no attempt to stop even though should know they might hit the person.

Gross Negligence Exception

When the defendant’s behavior was grossly negligent, there is an exception to the contributory negligence doctrine. Gross negligence is considered “wanton conduct,” or reckless conduct without regard to the rights of others. Motor vehicle examples of gross negligence include:

  • Drunk driving
  • Excessive speed
  • Street racing

NC Auto Insurance Minimums Changed in July 2025 — Here’s Why It Matters

In July 2025, NC raised auto insurance minimums to $50,000 for bodily injury per person and $100,000 for bodily injury per accident. The property damage minimum per accident is now $50,000. The new limits also apply to motorcycles under separate motorcycle insurance policies.

Previously, it was $30,000 for bodily injury per person and $60,000 for bodily injury per accident. The former property damage minimum per accident was $30,000. Those limits were set in 1999.

After a quarter-century, the rise in auto insurance minimums more accurately reflects current costs. Most drivers know that an accident totaling a late model car is going to cost more than $30,000 to replace. While many vehicles on the road are worth more than $50,000, they are greatly outnumbered by those worth less.

Auto insurance is mandatory in North Carolina. Still, collisions involving uninsured and underinsured drivers, as well as hit and runs, are frequent. The increase in auto insurance minimums also applies to uninsured/underinsured drivers’ coverage. Now, if an uninsured driver wrecks your $35,000 car, your own uninsured drivers’ coverage will apply for that amount.

Motorists with significant assets are wise to purchase more than the mandatory minimum auto insurance coverage to protect themselves financially.

Jacksonville Car Accident Lawyer

North Carolina is a fault state when it comes to car accidents. That means the driver responsible for the collision must pay for medical expenses and property damage.

A car accident attorney serving Jacksonville will negotiate with the defendant’s insurance company so that you can focus on recovery. We are proud of our tough advocacy for our clients.

Jacksonville Truck Accident Lawyer

When a big rig and another vehicle collide, the outlook for the occupants of the smaller vehicle is grim. If they are fortunate enough to survive the crash, they will likely suffer serious injuries, often leading to permanent disability; their medical bills and related needs may run into the millions; and they may never work again.

Truck accidents do not necessarily involve one vehicle hitting another. Improperly loaded trucks may jackknife or roll over, causing havoc along the highway. Poorly secured cargo could spill out into the roadway, resulting in multiple vehicle accidents as drivers scramble to get out of the way.

A Jacksonville truck accident attorney is familiar with federal and state trucking laws. We will ascertain whether the truck driver complied with Hours of Service regulations and obtain the black box data from the truck.

We will identify all defendants based on the circumstances of the case. While the truck driver and trucking company are usually at fault, other defendants may include the cargo company, manufacturer or repair facility.

Jacksonville Workers’ Compensation Attorney

After an on-the-job work injury, workers’ compensation is designed to pay your medical bills as well as provide partial weekly wage replacement. If it is determined that you cannot return to your former job, vocational rehabilitation is available. Unfortunately, workers’ compensation claims are often denied or the severity of the injuries minimized by the employer’s insurance adjuster.

That is where a  Jacksonville workers’ compensation attorney comes in. Many claims are denied due to missing information or deadlines. Your lawyer handles all the negotiations with the employer’s insurer and represents you at formal hearings. We calculate the true value of your workers’ compensation claim, based on your medical expenses, prognosis, and lost wages. We fight so that you receive the permanent disability rating you deserve.

Jacksonville Medical Malpractice Attorney

A Jacksonville medical malpractice attorney at Rhine Law Firm is especially qualified to handle North Carolina’s complicated medical malpractice legal requirements.

North Carolina Rules of Civil Procedure, Rule 9(j) states the necessary requirements to file a medical malpractice lawsuit against a healthcare provider.

Under Rule 9(j), a qualified medical expert must review the patient’s records and sign a sworn statement that the defendants did not meet the standard of care. Expert witnesses cost a great deal of money. Few personal injury law firms in North Carolina are equipped to handle this procedural barrier. Rhine Law Firm is an exception and has expertise in this area.

In North Carolina, nursing home abuse claims are usually filed as medical malpractice cases.

Non-economic damages in North Carolina medical malpractice cases are capped at $500,000. There are exceptions for cases involving intentional misconduct, fraud, or malice.

Jacksonville Motorcycle Accident Lawyer

Because motorcyclists do not have a protective metal shell around them, motorcycle accident injuries are typically far more serious than those of car accidents. Fatalities are frequent, and those surviving the crash may suffer horrific injuries. If another party caused the accident, you may be able to file a motorcycle accident lawsuit.

A Jacksonville NC motorcycle accident lawyer works with experts, such as accident investigators and reconstructionists, to build your case. We collect evidence, interview eyewitnesses, and review medical records and police reports. Proving fault in a motorcycle accident may involve subpoenaing the at-fault driver’s cellphone records and nearby surveillance video.

Wrongful Death, Premises Liability, & Catastrophic Injuries

Property owners in North Carolina must keep their premises in a reasonably safe condition, fixing any known hazards or warning visitors, such as placing Wet Floor signs in supermarkets and office buildings. If they don’t, they may be liable for injuries that occur on their property.

Catastrophic injuries are those from which the victim will never fully recover. These include:

  • Amputation
  • Major organ damage
  • Multiple fractures
  • Severe burns
  • Spinal cord injuries
  • Traumatic brain injury

A Jacksonville NC injury attorney at Rhine Law Firm represents victims of negligence in these areas and fights for them to receive the maximum compensation.

All personal injuries impact the victim and their family. In a worst-case scenario, the victim succumbs to their injuries. A NC wrongful death lawyer can file a lawsuit on behalf of the decedent’s estate for the benefit of their family.

What Compensation is Available in a North Carolina Injury Case?

The purpose of a personal injury civil claim is to make the victim “whole” again financially, or as close to it as possible. Depending on the nature and severity of your injuries, you may be entitled to both economic and non-economic damages.

Economic damages represent the objective, quantifiable financial losses resulting from your injury, such as:

  • Current and future medical bills
  • Rehabilitation and physical therapy expenses
  • Lost wages
  • Diminished earning capacity if you cannot return to your previous line of work
  • Property damage repairs

Non-economic damages account for the subjective, intangible losses that do not come with a clear receipt or price tag, including:

  • Physical pain and suffering
  • Emotional distress
  • Mental anguish
  • Loss of enjoyment of life
  • Permanent scarring or disfigurement
  • Loss of companionship or consortium

Our firm works closely with medical providers, economists, and life-care planners to accurately calculate the full, long-term scope of your losses so we can pursue maximum compensation on your behalf.

Serving Jacksonville’s Military Community — Camp Lejeune & Beyond

Jacksonville is home to Marine Corps Base Camp Lejeune, one of the largest Marine installations in the world. A significant portion of the local population is active-duty military, veterans, or military families. Unfortunately, many of these residents may have been exposed to contaminants from Camp Lejeune’s water and subsequently developed serious illnesses or issues. These include various types of cancer as well as infertility, miscarriage, and children with birth defects.

Military families that were based at Camp Lejeune from August 1953 to December 1987 and developed these conditions may prove eligible to join a  Camp Lejeune water contamination lawsuit.  They were potentially exposed to “contaminated drinking water. Industrial solvents, such as trichloroethylene (TCE) and perchloroethylene (PCE), from dry-cleaning waste and benzene from leaking underground fuel storage tanks were detected in the water on the base,” as per the U.S. Department of Veterans Affairs.

Rhine Law Firm has deep Camp Lejeune water contamination litigation experience that competing Jacksonville-area personal injury lawyers do not offer. We understand the unique challenges members of the military face.

“Jacksonville’s military families can face legal challenges that require experienced representation. We are committed to helping injured service members, veterans, and families across Onslow County protect their rights and pursue the compensation they deserve.” – Joel Rhine

  • Mental anguish
  • Disfigurement

The amount of compensation is usually related to injury severity and long-term prognosis.

Jacksonville Personal Injury FAQ

What is the statute of limitations for filing a personal injury lawsuit in North Carolina?

In most cases, the statute of limitations for filing a NC personal injury lawsuit is three years from the injury date. That deadline holds true when a government agency is the defendant, but many local ordinances require a Notice of Claim to be filed first. The deadline for filing a Notice of Claim ranges from six months to one year from the injury date.

For a wrongful death lawsuit, the statute of limitations is two years from the death date.

What is contributory negligence?

North Carolina is one of the few states that follow the contributory negligence rule. Under this rule, if the plaintiff was responsible for even 1 percent of their injuries or damages, they cannot collect compensation from the defendant.

There are state doctrines that can mitigate the harsh effects of the contributory negligence rule for injured plaintiffs.

How much does a personal injury lawyer in Jacksonville NC cost?

Most personal injury lawyers work on a contingency basis. The plaintiff pays no upfront costs. If they do not receive a settlement or favorable verdict, they owe their personal injury attorney nothing. If they do receive a settlement or favorable verdict, they pay a percentage of the award to their attorneys.

That fee ranges from one-third of the final settlement if an agreement is reached before a lawsuit is filed, to 40 percent if the case is decided at trial.

Can I still recover compensation if I was partially at fault in NC?

Due to NC’s strict contributory negligence rule, it is difficult to recover compensation if you are partly at fault for the accident causing your injuries. There are exceptions, such as gross negligence on the part of the defendant.

What should you do after suffering an injury caused by another party?

Document the scene to the greatest extent possible. That means taking photos and videos of the accident scene, obtaining the names and addresses of any eyewitnesses, and calling the police if the accident involves a motor vehicle.

Seek immediate medical attention, even if you do not think you were seriously injured initially. Follow the doctor’s orders exactly. Do not post anything about the situation on social media.

Contact a Jacksonville NC personal injury lawyer right away. Waiting too long can mean critical evidence disappears, including local surveillance videos.
