Can You File a Police Report Days or More After an Accident?

If a car accident in North Carolina results in injury, death, or property damage of $1,000 or more, state law requires that it be reported to law enforcement without delay. However, if you could not remain at the scene because, for example, you were transported by ambulance, the law recognizes that immediate reporting may not be feasible under those circumstances. In such cases, if law enforcement has not already responded to the accident and created a report, you should notify the appropriate law enforcement agency as soon as reasonably possible. This generally involves contacting the local police department, sheriff’s office, or the North Carolina State Highway Patrol, depending on the location of the accident.

In many car accidents, especially serious ones, a police report is filed at the scene. But there are situations where that doesn’t happen.

Here are common reasons why a report may be missing:

  • The Injured Driver Was Taken Away for Emergency Care. When a driver is seriously injured and transported by ambulance, they may be unable to speak with responding officers, delaying their ability to provide a statement or confirm details at the scene.
  • No Officer Was Called to the Scene. In minor collisions, drivers may mistakenly believe they don’t need to involve law enforcement—especially if the damage appears limited and both parties seem agreeable. NOTE: Always call the police! Even small-seeming accidents may result in painful injuries that do not present immediately.  An accident report is crucial to filing with insurance.
  • Law Enforcement Was Overwhelmed or Unavailable. In some cases, during storms, major emergencies, or periods of high call volume, police may be delayed or unable to respond, and drivers are left to report the incident themselves later.
  • Driver Confusion or Shock. Right after an accident, especially one involving trauma, injured motorists may be disoriented and unsure of what to do, leading to missed steps, including contacting law enforcement.

Regardless of the reason, if a police report wasn’t filed at the scene, it’s often still possible and advisable to take corrective action. Filing a report later or submitting a supplemental statement can help preserve your legal and insurance rights.

What If It’s Been Days or Weeks Since the Crash?

Filing a police report days or even weeks after an accident is sometimes possible, but the longer you wait, the more scrutiny your claim may face.
