What If a Truck Driver Forgets Their Pre-Trip Inspection

What If a Truck Driver Forgets Their Pre-Trip Inspection?

By Rhine Law Firm, P.C.

If a truck driver neglects to perform their pre-trip inspection, it can lead to serious safety risks and potential legal consequences. These inspections are a legal requirement under federal and North Carolina law, designed to ensure a vehicle is roadworthy and to prevent accidents caused by equipment failure. If an accident occurs and it’s discovered that the driver skipped this step, both the driver and the trucking company may be held liable for negligence.

truck accident lawyer at the Rhine Law Firm can investigate whether a required pre-trip inspection was conducted, examining records such as Driver Vehicle Inspection Reports (DVIRs) and Electronic Logging Device (ELD) data for inconsistencies or omissions that may point to negligence. Our team protects your rights while fighting for you to receive the maximum compensation you deserve for your losses and damages.

Pre-Trip Inspection Checklist

Requirements for Pre-Trip Inspections

Under the Federal Motor Carrier Safety Administration (FMCSA) regulations, truck drivers are required to inspect their vehicles before every trip to ensure they are in a safe operating condition.

This includes checking for any defects or issues that could impact safety or lead to mechanical failure. Pre-trip inspections are mandatory for all commercial trucks, including those carrying hazardous materials and short-haul vehicles over 10,000 pounds, such as those operated by UPS, FedEx, and other delivery services.

Pre-Trip Inspection Checklist

During a pre-trip inspection, which typically takes a new driver around 30 minutes and an experienced driver about 15, drivers must carefully examine key vehicle components to ensure safe operation. These include, among others:

  • Tires – Check for proper inflation, tread depth, and any visible damage or wear.
  • Brakes (service and parking) – Ensure all brake components function properly and show no signs of air leaks or wear.
  • Steering mechanism – Inspect for looseness, worn parts, or fluid leaks that could affect steering control.
  • Lights and reflectors – Confirm all headlights, brake lights, turn signals, and reflective devices are working and intact.
  • Horn – Test to ensure it is audible and functioning correctly.
  • Fuel system – Look for leaks or damage to fuel lines and tanks.
  • Windshield wipers – Check blade condition and washer fluid levels to ensure visibility.
  • Mirrors – Ensure mirrors are clean, properly adjusted, and securely mounted.
  • Emergency equipment – Verify the presence and condition of fire extinguishers, warning triangles, and spare fuses.
  • Coupling system – Examine the fifth wheel, kingpin, and all connections for secure attachment and wear.
  • Trailer – Inspect the trailer’s frame, doors, and lights, along with its suspension and brake system.

If a defect affecting safety is present, whether carried over from a previous inspection or newly discovered, the driver is not allowed to operate the truck until the issue has been resolved. They must report the problem to the carrier’s maintenance department or, if they are an owner-operator, arrange for the necessary repairs.

Driver and Carrier Liability for Inspection Failure

As noted, the FMSCA requires commercial truck drivers to conduct a pre-trip inspection before every shift. Failing to perform this inspection is not only negligent but also a violation of federal law. Skipping or rushing through a pre-trip inspection can have devastating consequences. Cutting corners not only jeopardizes road safety but also increases the risk of liability in the event of an accident.

Importantly, the legal responsibility for ensuring a truck is safe to operate does not rest solely with the driver. If the driver is employed by a motor carrier, the company also bears liability, particularly if a crash is caused by a defect that should have been identified during routine inspections. In such cases, both the driver and the carrier may be held accountable for injuries, damages, and regulatory violations.

How Rhine Law Firm Can Help Your Truck Accident Case

Our experienced lawyers have a proven track record of securing substantial verdicts and settlements for our clients. We build each case with meticulous attention to detail, gathering and analyzing all available evidence to uncover negligence or regulatory violations, including:

  • Black box (event data recorder) information – Data on speed, braking, acceleration, and mechanical functions just before the collision.
  • Electronic Logging Device (ELD) data – Logs of the driver’s hours of service and duty status, used to detect potential violations of federal rest requirements.
  • Surveillance and dash cam footage – Sourced from traffic cameras, nearby businesses, or vehicles at the scene.
  • Photographic and video evidence – Documenting vehicle damage, road conditions, skid marks, injuries, and the overall scene.
  • Eyewitness statements – Accounts from other drivers, pedestrians, or bystanders that clarify the events leading up to the crash.
  • Police reports – Including citations, diagrams, and officer assessments of fault.
  • Medical records – Demonstrating the extent of your injuries and the impact on your health and livelihood.
  • Vehicle maintenance and inspection records – Showing whether safety checks were performed correctly and documented.
  • Driver compliance and qualification files – Including CDL status, drug and alcohol testing, and training history.

While most truck accident cases are settled, we will take your case to court if the insurance company fails to agree to a fair settlement amount.
